Terms and Conditions of Service - Musicians, Labels, Producers, etc.
 

[1] Schedule for Fulfillment. Monday to Friday, except USA holidays when USPS is closed. Order Processing Times:

  • Orders received by 12:00pm EST will be processed that business day.

[2] Order Processing.

  • If unforeseen events (such as computer down, power outage, etc.) delay the order processing, LabelWhite will fulfill orders during the following business day.
  • Clients must be in good standing for orders to be fulfilled. LabelWhite may hold processing orders if accounts are in dispute.

[3] Shipping Options. Clients acknowledges the following shipping options are available to its customers, and they agree not to list on their website any shipping methods not listed below.

    Domestic Orders

  • Standard--2-5 days delivery to destination
  • Expedited -- 1-2 days delivery to destination (where available)
  • International (shipping from USA to another country)Orders

  • Standard -- 5-12 days to destination
  • Expedited -- 3-7 days to destination (where available)

The cost of postage and handling for each service is determined by LabelWhite, and added to the order at check-out time. (The cost of shipping and handling is not deducted from the profit made musicians, record labels, producers, etc. for the sale of each DVD, but rather it is paid for by the buyer of the DVD at check-out.)

[4] Replacement. Clients agree to bear the cost of re-shipping "lost" products to its customers, including the cost of the product, the fulfillment cost, and postage.

  • In the event a buyer claims that LabelWhite mis-shipped a product, we require the original product(s) to be returned first before shipping out a replacement. In the case where it is verified LabelWhite?_Ts mistake, then we will bear the postage and fulfillment cost for the replacement; although musicians, record labels, producers, etc. will bear the cost of the replacement product.
  • In the event a where a buyer refuses to return the product, then it will be at LabelWhite?_Ts discretion whether or not to send a replacement.
  • For replacement of international buyers, clients agree to bear all cost. From experience, it is not economical to have buyers send products back to the USA.

[5] Inventory Report. Musicians, record labels, producers, etc. acknowledge that the inventory data provided in real-time from the LabelWhite site is estimated. The actual quantity may be different due to time gap of orders in process and reconciling returns and replacements. From time-to-time, we will audit the inventory inside the warehouse and update the records. Incoming inventory verification. If a client requires incoming inventory count validation, then a labor service fee (at $25/hr., minimum 1 hr) will apply. Without an incoming count verification, it may be possible that actual inventory will be off.

[6] Termination of service/Non-payment. Clients may terminate service at any time without penalty. LabelWhite shall make all inventory products available for pickup within 48 hours. We will clear all outstanding balances before products are released. LabelWhite may for any reason terminate a client's service with a 21 days notification to a clients last know address or e-mail. If after 45 days elapses without inventory pick-up, musicians, record labels, producers, etc. agrees to allow LabelWhite to dispose the inventory as we see fit, including selling the inventory to recover unpaid balances.
